1 Introduction
Welcome to futuristic-art.com (the “Website”). The Website and the AI image-generation features (together, the “Services”) are operated by Paradoxeer s.r.o., a company registered in the Czech Republic (Reg. No. 23375141) with its seat at Dandova 2619/13, Horní Počernice, 193 00 Praha, Czech Republic (“Futuristic Art”, “we”, “us”, “our”).

2 What the Services Do
Futuristic Art lets you submit text prompts to generative-AI models to create images. Results can be downloaded immediately or stored in your account. Unless we agree otherwise in writing, the Services are provided for personal, non-commercial use.
3 Eligibility & Registration

Minimum age & capacity. You must be at least 18 years old and legally able to enter contracts where you live.

Prohibited locations. You may not use the Services from any state or region subject to EU or Czech sanctions or where the Services would be unlawful.

Accurate data & security. Registration details must be true, current and complete, and updated as needed. You are responsible for safeguarding your password and for everything that happens in your account. Notify us immediately of unauthorised use.
4 Wallet, Pricing & Payment (TOP UP)

Prepaid wallet. The Service uses a prepaid wallet balance (the “Wallet”). You can add funds via TOP UP. The minimum top-up is €5. Balances are shown in euros (EUR).

Per-request charges. Each image request deducts a fee from the Wallet. Typical pricing (indicative):
– New Request (standard generation) ≈ €0.88 per request;
– Premium Request (with additional parameters/options) ≈ €3.00 per request.
The exact price for your request is displayed before you confirm generation. -
Payment methods. The payment options available at checkout (e.g., major cards) are listed on the Site. Applicable taxes (if any) are shown before payment.

Receipts. A VAT invoice/receipt is emailed automatically after each successful top-up.

No credits. We do not operate a “credit” system. All use is billed per request against your Wallet.

No cash-out. Wallet funds are non-redeemable for cash and non-transferable, except where mandatory law requires otherwise.

Price changes. Price updates are prospective and do not affect previously added Wallet funds; the current per-request fee is always shown before you generate.
Consumer withdrawal (digital content). By clicking “Generate now” you request immediate performance of a digital content service not supplied on a tangible medium and acknowledge that, once generation starts, your statutory 14-day withdrawal right does not apply to that specific generation (Czech Civil Code § 1837(l)).
5 Refunds & Service Credits

Corrupted/unreadable files. Notify us within 14 days. We will re-issue the file or, if impossible, credit back the exact per-request fee deducted for that generation.

Platform-wide outages. If a widespread interruption prevents image generation for over 48 hours and you hold unused paid Wallet funds, we will add service credits (or equivalent balance) on request.

No change-of-mind refunds. We don’t refund Wallet funds or per-request fees because you changed your mind or dislike a stylistic result (you see price and options before confirming).

Top-ups. Top-ups are not refundable or redeemable for cash (unless required by law). This does not affect your rights where we failed to deliver a paid generation.
6 Acceptable Use
You must not:

use the Services for unlawful purposes;

create, upload or disseminate hateful, obscene, defamatory or infringing material;

violate intellectual-property, privacy, publicity or likeness rights (e.g., unauthorised use of brand marks or identifiable persons);

introduce malware, disrupt or attempt unauthorised access to our systems;

reverse-engineer, decompile or tamper with the Services;
-
bypass per-request billing or security safeguards.
Breaches may lead to content removal, account suspension or termination and, where appropriate, reporting to competent authorities.
7 Your Content & Intellectual Property

Ownership. Subject to third-party rights, you own the lawful rights in images you generate (“User Content”).

Licence to us. You grant Futuristic Art a worldwide, non-exclusive, royalty-free licence to host, back-up, display and technically adapt User Content solely to operate, maintain and improve the Services.

Your responsibilities. You warrant that your prompts and User Content are lawful and non-infringing. You are responsible for any required IP clearance, model/property releases, fact-checking and compliance before publication or commercial use.

Originality not guaranteed. AI outputs may resemble existing works; uniqueness or non-infringement is not guaranteed.
8 Our Intellectual Property
All software, models, algorithms, designs, trademarks and other materials we provide (“Futuristic Art Materials”) are our exclusive property or that of our licensors. Except for the limited licence in § 7, no rights are granted. You may not copy, modify or create derivative works from Futuristic Art Materials without written permission.
9 Changes to Service or Terms
We may alter, suspend or end any feature at any time. If a change materially disadvantages you, we will give reasonable advance notice via e-mail or in-app message. Continuing to use the Service after the effective date means you accept the updated Terms.
10 Disclaimer of Warranties
The Services and all outputs are supplied “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for purpose and non-infringement. No advice or information creates any warranty unless expressly stated here.
11 Limitation of Liability
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or any liability that cannot be limited under Czech law. Subject to the above, our total liability for direct damages is limited to the amount you paid to us in Wallet top-ups in the 12 months preceding the event. We are not liable for indirect or consequential losses (including loss of profit, data or reputation).
12 Indemnity
You agree to indemnify and hold harmless Futuristic Art, its directors, employees and affiliates against any claims, losses or expenses arising from (a) your use of the Services, (b) your breach of these Terms, or (c) infringement of third-party rights by your prompts or User Content.
13 Governing Law & Disputes
These Terms are governed by Czech law. The courts of Prague have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services. EU consumers may also raise matters in their home state and may use the EU Online Dispute Resolution platform.

15 Miscellaneous
Entire agreement. These Terms are the whole agreement between you and us regarding the Services.
Severability. If any provision is invalid, the rest remains in force.
No waiver. Failure to enforce a provision does not waive our rights.
Assignment. You may not transfer your rights without our consent; we may assign ours in connection with a business transfer.
